These Terms and Conditions ("Terms") govern your access to and use of the Vocaire platform ("Platform"), an online tool that allows physiotherapists to record their conversations with patients and, with the use of AI technology, generate medical journal drafts from the recordings. By using the Platform, you agree to be bound by these Terms.
Your privacy and the protection of personal information are essential to us. Please refer to our Privacy Policy to understand how we collect, store, and use personal information, including sensitive medical information, and our compliance with data protection laws such as HIPAA (US), GDPR (EU), or any other applicable regulations in the regions we operate.
Vocaire retains all rights, title, and interest in the Platform, its content, and the AI technology used to generate medical journal drafts. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for the purpose of creating medical journal drafts. The ownership and usage rights of the content created by users on the Platform shall remain with the users but are subject to the rights granted to Vocaire as outlined in these Terms and our Privacy Policy.
Access to the Platform is granted on an as-needed basis, and applications are reviewed by humans. To be eligible for access, users must meet certain qualifications or requirements, such as professional licensing. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Unauthorized access or misuse of the Platform may result in termination of service and potential legal action.
Detailed information on pricing, subscription plans, and payment terms for using Vocaire can be found on our website. By agreeing to these Terms, you acknowledge your understanding and acceptance of the applicable fees, payment terms, and any cancellation or refund policies. Failure to make timely payments may result in suspension or termination of your access to the Platform. Cancellations can only be made through the Vocaire platform, at app.vocaire.ai. Vocaire reserves the right to charge your credit card on file for extra services as per any written agreement.
Vocaire strives to provide a reliable and high-quality service but does not guarantee uninterrupted or error-free availability. We offer customer support through various channels, as described on our website, and will make reasonable efforts to address any issues in a timely manner. However, we are not liable for any damages or losses resulting from the unavailability or performance of the Platform.
Vocaire integrates with various medical journaling software. We do not guarantee the compatibility or support for all third-party software and are not responsible or liable for any issues arising from such integrations. Users are responsible for understanding and complying with the terms and conditions of any third-party software they choose to use in conjunction with Vocaire.
To the maximum extent permitted by law, Vocaire shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from the use or inability to use the Platform or the AI-generated content, even if Vocaire has been advised of the possibility of such damages.
The Platform and AI-generated content are provided "as is" and without any warranties, express or implied. Vocaire does not guarantee the accuracy, completeness, or suitability of the generated content for any particular purpose. Users are responsible for verifying the accuracy and appropriateness of the content before using it for any professional or clinical purposes.
Either party may terminate this agreement at any time by providing a notice through the Vocaire platform, app.vocaire.ai to either party. Vocaire reserves the right to terminate or suspend access to the Platform if a user is found to be in breach of these Terms or has engaged in any fraudulent or unlawful activities.
