These Terms and Conditions ("Terms") govern your access to and use of the Voicare platform ("Platform"), an online tool that allows medical staff to record their conversations with patients and, with the use of AI technology, generate medical journal drafts from the recordings. By using the Platform, you agree to be bound by these Terms.
Your privacy and the protection of personal information are essential to us. Please refer to our Privacy Policy and DPA to understand how we collect, store, and use personal information, including sensitive medical information, and our compliance with data protection laws such as HIPAA (US), GDPR (EU), or any other applicable regulations in the regions we operate.
Where Voicare processes personal data on behalf of the Customer, including patient data or health data, Voicare acts as data processor and the Customer acts as data controller, unless otherwise agreed in writing. Such processing is governed by the applicable Data Processing Agreement, which may be Voicare’s standard Data Processing Agreement or another written data processing agreement agreed with the Customer.
In the event of conflict between these Terms and the applicable Data Processing Agreement regarding the processing of personal data, the applicable Data Processing Agreement shall prevail.
Voicare retains all rights, title, and interest in the Platform, its content, and the AI technology used to generate medical journal drafts. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for the purpose of creating medical journal drafts. The ownership and usage rights of the content created by users on the Platform shall remain with the users but are subject to the rights granted to Voicare as outlined in these Terms and our Privacy Policy.
Access to the Platform is granted on an as-needed basis, and applications are reviewed by humans. To be eligible for access, users must meet certain qualifications or requirements, such as professional licensing. Users are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account. Unauthorized access or misuse of the Platform may result in termination of service and potential legal action. The Customer is responsible for all actions and omissions of its administrators, employees, invited users, registered users, and any other persons granted access to the Platform through the Customer’s account, organisation, or workspace.
The Customer is solely responsible for ensuring that it has a valid legal basis, including any required patient consent, notice, or other lawful basis, to record consultations and process patient data through the Platform.
The Customer is responsible for ensuring that all use of the Platform complies with applicable laws, professional obligations, ethical rules, and internal policies, including rules relating to patient confidentiality, medical records, and data protection.
Detailed information on pricing, subscription plans, trial periods, discounts, and payment terms for using Voicare can be found on our website or in the order flow at the time of purchase. Additionally current subscription info can be found on the platform for admins. By creating an account, starting a trial, inviting users, or continuing to use the Platform, the Customer accepts the applicable fees, payment terms, and these Terms.
Voicare charges a per-user fee. Unless otherwise agreed in writing, billable users include all users who have access to the Platform, including invited users, registered users, active users, and any other user accounts created under the Customer’s organisation or account. Voicare may charge for new users, invitations, seats, or other paid access added during a billing period on a prorated basis for the remaining part of that billing period. Such prorated charges may be charged immediately, added to the next invoice, or charged together with the next billing cycle.
Voicare may change subscription fees, plans, features, or billing terms by giving reasonable notice to the Customer. Continued use of the Platform after the effective date of such changes constitutes acceptance of the updated fees, plans, features, or billing terms.
Voicare may offer free trials, freemium access, or promotional access at its sole discretion. Unless otherwise expressly agreed in writing, each Customer, organisation, clinic, company, email domain, payment method, and/or individual user is entitled to only one free trial or freemium period.
The Customer may not create, or attempt to create, multiple accounts, workspaces, organisations, email addresses, or user profiles in order to obtain repeated free trials, avoid payment, bypass usage limits, or otherwise access the Platform without paying applicable fees.
If Voicare reasonably determines that a Customer or user has used repeated free trials, freemium accounts, duplicate accounts, or similar methods to access the Platform beyond the intended free access, such use shall be deemed a purchase of the applicable paid subscription from the date the Customer first exceeded the permitted free use or from the start of the repeated or abusive free trial use, as determined by Voicare acting reasonably.
In such cases, Voicare reserves the right to charge and send invoice to the Customer for the applicable subscription fees, including for all users and usage during the relevant period. Voicare may also suspend or terminate access to the Platform.
